1. LIFETIME CARE RESPONSIBILITY

 

Buyer agrees to provide a lifelong commitment to the puppy, including appropriate shelter, nutrition, veterinary care, vaccinations, parasite prevention, grooming, exercise, and a safe living environment.

 

Buyer agrees never to knowingly subject the dog to neglect, abuse, abandonment, or unsafe conditions.

 

2. HEALTH AT TIME OF SALE

 

Seller represents that, to the best of Seller's knowledge and based on available veterinary findings, the puppy is in good health at the time of transfer, except for any conditions disclosed in writing.

 

Available vaccination, deworming, and veterinary records will be provided to Buyer.

 

Buyer is encouraged to avoid unnecessary exposure to unfamiliar dogs and high-risk environments until the puppy has received appropriate vaccinations.

 

3. INITIAL VETERINARY EXAMINATION

 

Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of receiving the puppy.

 

Buyer must promptly notify Seller in writing of any significant health concern identified during this examination and provide supporting veterinary documentation.

 

Failure to obtain the examination may affect claims that require proof a condition existed at transfer, subject to applicable law.

 

4. INITIAL HEALTH CLAIMS

 

If a licensed veterinarian determines that the puppy had a significant illness, disease, or congenital condition at the time of transfer that materially affected its fitness for sale, Buyer must notify Seller promptly and provide written veterinary findings.

 

Seller may request an independent veterinary examination to verify the diagnosis.

 

For a verified qualifying condition, Seller will offer a replacement puppy of comparable purchase value, subject to the replacement and original-dog welfare provisions in Section 6.

 

A replacement shall be provided within 12 months following written approval of the claim.

 

The original puppy shall not automatically be required to be returned. HighStyles Danes will determine whether return is appropriate, giving primary consideration to the puppy's health, welfare, and established family bond.

 

Nothing in this section limits any nonwaivable remedy available under applicable law.

 

5. 72-HOUR COMMUNICABLE DISEASE GUARANTEE

 

Seller provides a 72-hour limited health guarantee against serious communicable viral diseases, including canine parvovirus and distemper, where veterinary evidence establishes that the infection was present or contracted before transfer.

 

Buyer must seek prompt veterinary treatment and notify Seller immediately upon diagnosis.

 

Coccidia, Giardia, kennel cough, and other treatable conditions are not automatically considered qualifying genetic conditions. Claims involving these illnesses will be evaluated according to the puppy's condition at transfer and applicable law.

 

6. 26-MONTH GENETIC HEALTH GUARANTEE

 

HighStyles Danes guarantees the puppy against serious, life-altering or fatal hereditary genetic and congenital conditions that substantially affect the dog's health or quality of life until the puppy reaches 26 months of age.

 

A qualifying claim must be supported by a written diagnosis from a licensed veterinarian. Seller may request additional veterinary documentation or an independent veterinary opinion when reasonably necessary.

 

Replacement Guarantee

 

Upon approval of a qualifying genetic health claim, Seller agrees to provide one replacement puppy of comparable purchase value, preferably from different bloodlines when reasonably available.

 

The Seller shall have up to 12 months from the date of written claim approval to provide the replacement puppy.

 

No cash refund is offered as the contractual remedy under this voluntary genetic replacement guarantee, except where otherwise required by law.

 

Buyer is responsible for transportation or shipping costs associated with receiving the replacement puppy.

 

Original Dog Return Policy

 

HighStyles Danes recognizes that dogs become cherished members of their families and that removing a dog from its established home may cause unnecessary emotional distress.

 

The original dog will not automatically be required to be returned when a genetic health claim is approved.

 

HighStyles Danes reserves the right to determine whether return of the original dog is a condition of receiving a replacement, based on the dog's medical condition, quality of life, safety, emotional well-being, and established bond with its family.

 

When Seller determines that remaining with the Buyer is in the dog's best interest, Buyer may retain the original dog and receive the approved replacement puppy without an additional purchase price.

 

When medically appropriate, Seller may require spaying or neutering of the affected dog, subject to veterinary guidance, before releasing the replacement.

 

If Seller determines that a return is appropriate, the parties will arrange a safe and humane transfer, with the dog's welfare remaining the primary consideration.

 

One Replacement Limit

 

Only one replacement puppy may be provided under this guarantee for each original puppy purchased.

 

The replacement puppy does not restart the original 26-month guarantee or establish entitlement to additional replacement puppies.

 

7. DEATH DURING GUARANTEE PERIOD

 

If the dog dies before reaching 26 months of age and a hereditary genetic or congenital condition is suspected, Buyer must notify Seller promptly.

 

Buyer agrees to arrange a veterinary necropsy, when reasonably available and medically appropriate, to establish the cause of death.

 

Buyer is responsible for necropsy expenses unless otherwise agreed in writing.

 

A necropsy report establishing a qualifying genetic or congenital cause of death will support a claim for one replacement puppy of comparable value under Section 6.

 

If a necropsy cannot reasonably be performed, Seller may consider other reliable veterinary evidence.

 

Replacement shall be provided within 12 months following written approval of the claim.

 

8. NOTIFICATION REQUIREMENTS

 

Buyer must notify Seller in writing within five business days after receiving a veterinary diagnosis that may qualify under the genetic health guarantee.

 

Buyer must provide available veterinary records and reasonably cooperate with verification of the claim.

 

9. VETERINARY CARE AND RECORDS

 

Buyer agrees to maintain appropriate veterinary care throughout the dog's development.

 

Buyer should retain records of vaccinations, parasite prevention, medical treatment, nutrition, and any significant medical concerns.

 

Relevant veterinary documentation may be requested when evaluating a guarantee claim.

 

10. ORTHOPEDIC HEALTH AND DEVELOPMENT

 

Great Danes are giant-breed dogs whose skeletal development can be influenced by genetics, nutrition, body condition, exercise, injury, and environmental factors.

 

Buyer agrees to provide age-appropriate nutrition, safe exercise, suitable resting surfaces, and reasonable protection against preventable injury.

 

Hip, elbow, and other orthopedic conditions will be evaluated using veterinary evidence to determine whether they qualify as hereditary or congenital under this guarantee.

 

A condition will not be excluded solely because environmental factors might also contribute to its development.

 

11. EXCLUSIONS

 

This genetic health guarantee does not cover conditions established by veterinary evidence to result primarily from injury, neglect, abuse, poisoning, preventable trauma, or other causes unrelated to a qualifying hereditary or congenital condition.

 

Common treatable illnesses, routine veterinary expenses, and elective procedures are not covered by the genetic replacement guarantee unless otherwise required by law.

 

Seller does not guarantee a specific adult height, weight, appearance, show success, fertility, or breeding performance.

 

12. DISCLOSURE OF KNOWN CONDITIONS

 

Seller agrees to disclose known significant health conditions before completion of the sale.

13. SPAY AND NEUTER REQUIREMENTS

 

Puppies sold with limited AKC registration or designated pet-only are not sold with breeding rights.

 

Buyer agrees not to breed such dogs.

 

Spaying or neutering should be scheduled in consultation with a licensed veterinarian, taking into consideration the dog's health, size, and development.

 

Unless a veterinarian recommends otherwise, the procedure should be completed by 24 months of age.

 

Unauthorized breeding constitutes a violation of this agreement and may affect contractual breeding-related protections, subject to applicable law.

 

14. AKC REGISTRATION AND KENNEL NAME

 

All AKC-registered puppies produced by HighStyles Danes must include HighStyles at the beginning of their registered names.

 

Registration rights are determined by the designation agreed upon at the time of sale.

 

15. BREEDING AGE REQUIREMENTS

 

Females sold with full breeding rights shall not be intentionally bred before 18 months of age and their second heat cycle.

 

Buyer agrees to obtain veterinary approval before breeding.

 

Breeding before the agreed minimum age constitutes a violation of this agreement.

 

16. NEGLECT, MISTREATMENT, AND ANIMAL WELFARE

 

Buyer agrees to maintain humane and responsible care throughout the dog's lifetime.

 

If Seller becomes aware of suspected neglect, abuse, or mistreatment, Seller may contact Buyer and seek appropriate intervention, including voluntary return or assistance from animal welfare authorities.

 

Nothing in this agreement authorizes Seller to enter private property or seize an animal without lawful authority.

 

Any transfer or recovery of the dog must comply with applicable law.

 

17. RETURN AND REHOMING POLICY

 

If Buyer becomes unable or unwilling to keep the dog at any point in its lifetime, Buyer agrees to contact HighStyles Danes before surrendering, selling, transferring, or rehoming the dog.

 

Seller shall be given the opportunity to accept the dog back or assist in locating an appropriate home.

 

Buyer is responsible for arranging and paying for transportation unless otherwise agreed.

 

If the dog is returned to Seller, applicable registration and veterinary records should accompany the dog.

 

No refund of the original purchase price is promised for a voluntary return, except as required by law.

 

18. NONTRANSFERABLE GUARANTEE

 

This genetic health guarantee applies only to the original Buyer and is not transferable to subsequent owners.

 

Buyer must retain a copy of this agreement and relevant veterinary documentation for future reference.

 

19. GOVERNING LAW AND AGREEMENT

 

This agreement shall be interpreted under the laws of the State of Ohio.

 

To the extent permitted by law, disputes shall be brought in a court of competent jurisdiction in Shelby County, Ohio.

 

No provision of this agreement shall waive any consumer protection, animal welfare, or other legal rights that cannot lawfully be waived.

 

Any modification to this agreement must be made in writing and accepted by both parties.

2. Health at Time of Sale

 

HighStyles Yorkies represents that, to the best of the breeder's knowledge, the puppy is in good health at the time of transfer, except for any conditions disclosed in writing.

 

Each puppy will be provided with available vaccination, deworming, and veterinary records.

 

The buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of receiving the puppy, excluding weekends and holidays when veterinary services are unavailable.

 

If a significant health concern is discovered during this examination, the buyer must promptly notify HighStyles Yorkies and provide written veterinary documentation.

 

Failure to complete the initial examination may affect coverage for conditions that reasonably could have been identified during that examination, to the extent permitted by applicable law. It does not automatically void the genetic health guarantee.

 

3. Two-Year Genetic Health Guarantee

 

HighStyles Yorkies provides a two-year genetic health guarantee beginning on the puppy's date of birth.

 

This guarantee covers serious hereditary or congenital medical conditions that substantially affect the puppy's quality of life or life expectancy.

 

To qualify for coverage:

 

1. The condition must be diagnosed by a licensed veterinarian within the two-year guarantee period.

2. Appropriate veterinary records and diagnostic testing must support the diagnosis.

3. The condition must be determined to be hereditary or congenital.

4. The buyer must notify HighStyles Yorkies within 14 days of receiving the diagnosis, or as soon as reasonably possible.

5. The buyer must provide the necessary veterinary documentation for review.

 

HighStyles Yorkies reserves the right to request a second veterinary opinion at the breeder's expense.

 

A second opinion shall not be used to unreasonably delay or deny an otherwise valid claim.

 

4. Genetic Health Claim Review and Approval

 

Upon receiving a genetic health claim and all required veterinary documentation, HighStyles Yorkies shall have thirty (30) calendar days to review the claim and provide the buyer with a written approval or denial.

 

If additional veterinary testing or a second veterinary opinion is reasonably necessary, the breeder shall notify the buyer within the initial 30-day period.

 

Any extension of the review period must be agreed upon in writing by both parties.

 

Approval or denial shall be based on the veterinary evidence and the terms of this agreement.

 

5. Replacement Puppy Guarantee

 

If a qualifying genetic condition is confirmed and the claim is approved, HighStyles Yorkies agrees to provide one replacement Yorkshire Terrier puppy of comparable purchase value.

 

The following terms apply:

 

1. Replacement Time Frame: HighStyles Yorkies shall have up to twelve (12) months from the date of written claim approval to provide the replacement puppy.

 

2. Availability: The replacement puppy shall be provided from an available or future HighStyles Yorkies litter within the twelve-month replacement period.

 

3. Comparable Value: The replacement puppy will be of comparable purchase value. The breeder does not guarantee identical sex, color, markings, adult size, or breeding potential.

 

4. Purchase Price: The replacement puppy will be provided without an additional puppy purchase price.

 

5. Transportation: The buyer is responsible for transportation or delivery expenses unless otherwise agreed in writing.

 

6. Refunds: No cash refund or veterinary expense reimbursement is offered under this voluntary genetic health guarantee, except where required by applicable law.

 

7. Completion of Guarantee: Providing the replacement puppy fulfills the breeder's obligations under this voluntary genetic health guarantee, subject to applicable law.

 

If a replacement puppy cannot be provided within the twelve-month period, the parties shall address the unfulfilled obligation in writing, without limiting any rights or remedies available under applicable law.

 

6. Return of Original Puppy Under Genetic Health Guarantee

 

HighStyles Yorkies reserves the right to determine whether the original puppy must be returned to the breeder as a condition of receiving a replacement puppy, subject to applicable law.

 

This decision shall be made on an individual basis.

 

The puppy's health, emotional well-being, established home environment, medical needs, and overall quality of life shall be the primary considerations.

 

HighStyles Yorkies recognizes that a puppy with a genetic health condition may have developed a strong bond with its family.

 

The breeder may, at their discretion, allow the original puppy to remain with its family while still providing a replacement puppy.

 

If the breeder determines that returning the original puppy is appropriate, arrangements shall be made to ensure the puppy's safety, continued medical care, and well-being.

 

The puppy shall not be required to travel against the advice of a licensed veterinarian.

 

The breeder's decision regarding the return of the original puppy shall be communicated to the buyer in writing.

 

The health, safety, and welfare of the Yorkie shall always take priority when making return decisions.

 

7. Conditions Not Covered by the Voluntary Genetic Guarantee

 

Unless established through appropriate veterinary evidence as a qualifying hereditary or congenital disorder, the following are not covered:

 

- Accidental injuries, trauma, or poisoning.

- Parasites or infectious diseases acquired after transfer.

- Hypoglycemia resulting from missed meals, inadequate nutrition, or improper care.

- Routine dental care, retained baby teeth, or dental cleaning.

- Conditions caused by neglect, obesity, improper nutrition, or preventable injury.

- Cosmetic differences or coat color changes.

- Adult weight, size, ear carriage, or appearance.

- Fertility, reproductive ability, or breeding potential.

 

Conditions including luxating patellas, congenital liver shunts, and other disorders recognized in Yorkshire Terriers may qualify when veterinary evidence establishes their hereditary or congenital origin and serious medical impact.

 

HighStyles Yorkies does not guarantee that a living animal will never develop a medical condition.

 

8. Buyer Responsibilities

 

The buyer agrees to provide the puppy with:

 

- Appropriate, age-specific nutrition and access to fresh water.

- Routine and emergency veterinary care as needed.

- Recommended vaccinations and parasite prevention.

- Proper grooming and dental care.

- A clean, safe, and suitable living environment.

- Appropriate socialization, exercise, and companionship.

- Protection from neglect, abuse, extreme temperatures, and dangerous environments.

 

The buyer acknowledges that Yorkshire Terriers are a small breed and that young puppies require careful attention to feeding schedules, body temperature, and signs of hypoglycemia.

 

The buyer agrees to seek veterinary care promptly if the puppy becomes ill or injured.

 

9. Lifetime Return-to-Breeder Policy

 

Once a HighStyles Yorkie, always a part of the HighStyles family.

 

HighStyles Yorkies offers a lifetime return-to-breeder commitment for every puppy produced by our breeding program.

 

If the buyer is ever unable or unwilling to keep the dog, regardless of the dog's age or the reason, the buyer agrees to contact HighStyles Yorkies before surrendering, selling, or transferring the dog.

 

HighStyles Yorkies agrees to accept the dog back at any age, with reasonable arrangements for safe transportation and continued care.

 

The buyer agrees to offer the dog back to HighStyles Yorkies before placing it with another individual, shelter, rescue organization, or other facility.

 

A voluntary return under this lifetime policy does not entitle the buyer to a refund of the original purchase price unless otherwise agreed in writing or required by law.

 

Unless otherwise agreed, the buyer is responsible for arranging and paying for safe return transportation.

 

The purpose of this policy is to ensure that no HighStyles Yorkie is left without a safe and caring home.

 

10. Rehoming and Ownership Transfer

 

The buyer agrees not to sell, surrender, or permanently transfer the dog without first contacting HighStyles Yorkies and offering the breeder the opportunity to accept the dog back.

 

If the breeder declines the return and approves another placement in writing, the buyer agrees to provide the new owner's contact information.

 

The buyer agrees that the dog shall not knowingly be transferred to a puppy mill, animal auction, broker, or research facility.

 

Emergency placement necessary to protect the dog's immediate health or safety is not prohibited by this section.

 

11. Veterinary Expenses

 

Following transfer, the buyer is responsible for routine and emergency veterinary expenses.

 

HighStyles Yorkies is not responsible for veterinary bills, diagnostic testing, surgery, medications, or other medical expenses unless separately agreed in writing or required by applicable law.

 

The voluntary genetic health guarantee provides the replacement remedy described in this agreement.

 

12. Humane Treatment and Animal Welfare

 

The buyer agrees to provide humane treatment, appropriate shelter, nutrition, veterinary care, and companionship throughout the dog's lifetime.

 

HighStyles Yorkies believes every puppy deserves a loving and stable home.

 

If the buyer is unable to continue providing appropriate care, the buyer agrees to contact the breeder to arrange a safe return.

 

The health, safety, and quality of life of every HighStyles Yorkie remain a priority throughout its lifetime.

 

13. Entire Agreement and Applicable Law

 

This agreement represents the written understanding between HighStyles Yorkies and the buyer regarding the puppy's genetic health guarantee and lifetime return policy.

 

Any modifications must be agreed upon in writing by both parties.

 

This agreement shall be governed by applicable Ohio law, subject to any mandatory consumer protection laws applicable to the transaction.

 

Nothing in this contract is intended to waive or limit rights or remedies that cannot legally be waived.

 

If any provision is determined to be unenforceable, the remaining provisions shall remain effective to the extent permitted by law.
